Im by no means looking for legal advice, but do any of you have experience with how this type of situation has worked out for you in regards to who was found at fault?
Well, here in OK, if both drivers are at fault, each person is responsible for the damages to their vehicle.
Splitting lanes is illegal, as is cutting across double yellows, so if it were me, I'd likely be paying my own bill.
However it sounds like you have a case for it to be their fault because tragic was slow and you were driving carefully when they swerved in front of you.
Ask a lawyer, either one that does traffic violations or a personal injury. They'll be familiar with state law and how proceedings usually go.
Cali laws are different. I was well within the law.

Then he's definitely at fault. Get a copy of the police report along with every receipt you can scrap together from your bike and injuries and submit it to the other insurance.
Buddy of mine got $13k for his 08R6 after someone totaled into him because he had a local shop value the man hours at their hourly rate that it would have taken to do all the work on the bike he had done himself.
Im mostly worried about getting the paint redone. I got an estimate to get 2 plastics color matched and it was gonna be almost $700 plus buying the paint. I have a feeling im gonna get dicked around on that.

True. The police report is merely evidence if the insurance decides a different way than you would like.
The bike probably won't shift into the gears due to a bent shift rod or shift assembly.

USAA is real good to work with. My bud crashed twice in a month and the second one was so close to totalled but the adjustor worked with both the rider and the repair shop to get it fixed under the totalled limit since it's a LE CBR
